Abstract
According to our reading of Marxs Capital, it is necessary to notice the distance (theoretical, not historical) between market and capitalism in order to show that the laws which really constitute Modern Society have not to do with Law but with Economy. We try to show that, certainly, Marx thinks that Citizenship project is powerless, unfeasible and even undesirable under capitalist conditions of production. Nevertheless, regardless of the kidnapping of Law de facto in Modern Society, according to our reading of Marxs Capital it would be possible to hold that this author defends, at least, the autonomy de iure between the conceptual system referred to the Citizenship project and the conceptual system we have to build to explain capitalist relations of production and exchange (whose main concept would obviously be the concept of social class). In order to do so, it is necessary to prove that Marxs Capital forcefully rejects the alleged validity of formula Modern Freedom = Market = Capitalism: Modern Freedom (individuals have the right to do what they want with their own person and their property) = Market (everyone employs his or her own person and property to obtain maximum profit when dealing with others) = Capitalism (the total economic system is completely based on profit production and the consequent capital accumulation).
