Abstract

During the Spanish Civil War, two different systems tried to impose their own concept of order by means of criminal law. Nonetheless, both jurisdictions (Republican faction and Nationalist faction) shared the use of summary proceedings without due process of law. The second part of the paper analyzes the figure of criminal law professor José Arturo Rodríguez Muñoz as an exponent of the "internal exile", taking into account both biographical data and a summary of his two most relevant contributions to the Spanish science of criminal law.
