Zusammenfassung

This research studies two sentences of two Constitutional Courts in electronic voting: first, the judgment 3rd March 2009 from the German Federal Constitutional Court and on the other, the judgment 13th December 2011 from the Austrian Constitutional Court. Both pronouncements establish the unconstitutionality and unlawful of electronic voting used in the respective electoral processes but reflect, in their legal basis, on various aspects to consider in order to legally regulate electronic voting in a future.
