Zusammenfassung

Ever since TRIPs Agreement harmonized patent standards among the progressively enlarged number of WTO members, State and social boundaries on access to medicines were taken to the media and political forefront thanks to the civil society determination. This Agreement introduced the compulsory patentability of pharmaceutical products and the protection of the analysis and clinical trials information required by national administrations to award commercial authorizations. Although, therefore, this Agreement has been the center of all the critics, its provisions facilitate certain flexibilities that member States can use in designing their national laws. This piece analyses the general situation of the Agreement without disregarding practice and, hence, the appearance of free agreements introducing higher protection standards, the so-called TRIPS-Plus commitments.
