Abstract
The investigation centres on the analysis of the problem of the terminological variety used in the processes, due to the ignorance of the low judges of the technical language and of each of the penal categories. This situation is stated not only in the documentation preserved in the Peninsula, but also in that of the New Spain. In the practice the terms I steal, theft and cattle rustling were using indistinctly to refer to the crime directed against the property of the persons, though the legislation was differing each of illicit these.
