Abstract
The change of domicile of a minor is particularly problematic when the custodial parent wishes to transfer his/her residence abroad, and intends thereby to modify the place of residence of the minor. Case law doctrine establishes that the decision on the establishment of the domicile of the minor can not be adopted unilaterally by the custodial parent, since the decision of the place where the child lives must not derive from custody, but from parental authority. In these cases, in the absence of agreement between the parents, the judge may authorize it only for the benefit and interest of minor children, after weighting of different criteria to be evaluated in accordance with the principles of necessity and proportionality.
