La protección jurídica de los derechos al honor, a la intimidad personal y familiar y a la propia imagen de los menores de edad

Abstract

The rights of the personality –such as the right to the honor, to the personal and familiar intimacy and the own image- of the persons in general and very specially from the minors like fundamental rights have to belong protected opposite to any illegitimate interference that can affect them not only in what it constitute if traditional field of operability but also in the new virtual space that internet represents. The new technologies, services and products related to the company of the information and the knowledge and the means of social communications –social networksconstitute on the one hand the vehicle or tool that makes possible the exchange of information, opinions, images, ideas and on the other hand they can favor illicit actions of certain unconsciousness or vulnerability of the persons who use these new technologies of the information. It turns out necessary to protect his holder and to guarantee in an effective way the full exercise of such rights of the personality on the different areas of possible actions and in the measures that have to be adopted for his protection, especially if the ownership corresponds to a minor and the consequences that stem from his violation.
