Control de armas en el nuevo federalismo americano

Resumen
En el presente trabajo se analizan las principales dimensiones constitucionales de la posesión de armas de fuego en los Estados Unidos de América: los derechos y libertades individuales, la seguridad pública, y la distribución de competencias entre la Federación y los Estados. En este análisis acudimos principalmente a la historia constitucional y a la hermenéutica de la doctrina constitucional del Tribunal Supremo americano, especialmente de las sentencias Heller y López. Se puede concluir que dicha jurisprudencia rompe dramáticamente con la progresiva federalización competencial desarrollada sobre la base de la cláusula comercial. A mayor abundamente, consideramos que actualmente no existen razones para un desarrollo constitucional favorable al control de armas.
