Resum
The drug trafficking crimes are a clearly manifestation of the “enemy criminal law”, characterized by the collapse of basic criminal principles that have not been made them up in our days under any perspective. Frequently, the deterioration of the citizens’ rights and guaranties is seem as an exclusive, or almost exclusive, legislative matter, without realize the relevant role of those who implement the law, particularly judges and Courts, through their coexistence and resistance. It has been picked up, between huge amounts of Spanish case decisions about drug trafficking, some examples of the relevant role of the judges and courts for this effects.
