Abstract
The increasing importance of forensic psychology in Spain has contributed with increasing frequency to expert advice to judges and courts in those aspects in which the principles of psychology can help to understand people’s legal behavior. The intervention of the forensic psychologist in violent recidivism risk assessment occurs in the criminal jurisdiction. It is essential to have a comprehensive training in violence assessment, and to clearly express the limitations of this type of techniques to legal operators and other professionals. This article provides a report developed by three forensic psychology experts, regarding violence risk assessment (sexual and non-sexual), in a case of rape and murder in which the offender presents exaggeration of symptoms related to the use of cocaine, justifying his lack of personal responsibility in the crimes committed. He also has an obsessive-compulsive personality disorder and antisocial traits together with a long criminal record. In addition, an introduction to the origin of the terms “murder” and “rape” and their classification within the Spanish penal code is presented. The results obtained are discussed with diverse bibliographic support.
