El nuevo reto del sector de la aviaciónel mercado de emisiones, análisis de algunos problemas

Resumen

This paper analyzes the new legal regime of the European Union Emission Trading Scheme, which is determined by the Directives 2008/101/CE and 2009/29/CE and the Spanish National Law13/2010. The European trading system of allowances in the aviation sector introduced by Directive 2008/101/EC aims to achieve the ultimate objectives of reducing emissions assumed by the European Union after the Kyoto Protocol. This article describes the main features of the EU scheme that enter into force on January the first 2012 and focuses on the Decision adopted by the European Court on December 2011. The main point of controversy is that the ETS will apply to foreign airlines to the extent they operate flights to and from EU airports.
