Résumé
The paper focuses on State aid control rules, regarding to Services of General Economic Interest. Specific, we analyze the pronuncements of Commision, General Court and Court of Justice of EU, relating to financing mechanisms designed in the framework of transition process from analogue to digital broadcasting in Spain. For this purpose, the economic nature of the activity, and the existence of economic advantage due to the financing mechanism are analyzed, paying special attention to possible concurrence of Altmark rules. Finally, we analyze the selectivity criteria, as well as the possible existence of the exception envisaged in art. 106.2 TFEU.
