Resumo

The interpretation of the special rules on international jurisdiction laid down in the EU trademark Regulation and other EU instruments on unitary rights poses particular challenges, including the interplay between those instruments and the Brussels I Regulation (Recast). Such challenges are of particular significance with regard to disputes arising from advertising and offers for sale displayed on websites. T h i s contribution discusses the recent evolution of the case–law of the CJEU in this field and assesses its implications in the broader context of EU jurisdiction rules on claims concerning the online infringement of IP rights.
