Resumo
States, as it is known, have the obligation to respect and protect the fundamental rights of any person under their jurisdiction in any circumstance, including situations of risk or threat to the exercise thereof derived from disasters that cause serious damage to the human environment – which requires the adoption of measures for the prevention of its violation, the mitigation of its effects and the repair of its consequences–. Compliancewith this obligation is especially important when dealing with legally vulnerable persons because they are more exposed to suffer the infringement of their rights
