Zusammenfassung

One more tool in the fight of States against irregular migration is criminalising those who help migrants and refugees. This article analyzes the legal framework that allows criminal prosecution, the so-called EU “Facilitators Package” that requires member states to penalise and punish aid to illegal entry, even without profit. The EU may exclude from criminal prosecution humanitarian behavior, but they are not obliged to do so. In addition, we will focus on the situation in the central Mediterranean, where the persecution of rescue NGO has been especially intense and carried out by institutions increasingly accessible to xenophobic ideology organizations. This article also explores why saving lives is not a crime but avoiding doing so is. To conclude we will refer to this issue in Spain from the legal, jurisprudential and political perspective.
