Abstract

After the ratification of the Convention on the Rights of Persons with Disabilities by our system and while moving towards the conversion into the Law of the Draft reform of civil and procedural legislation on disability that responds to one of the new challenges of the 21st century society, the Supreme Court’s jurisprudence has been concretizing some of the issues of radical change that is yet to come. Based on the right of equality of all persons in the exercise of their legal capacity, in which disabled persons must enjoy legal capacity on equal terms as others, a support system is established, the main focus of which will be the curatorship, as a measure of assistance and advice in making decisions that affect your personal, family or property interests.
