In the past thirty years Spain has failed to fulfil its obligations under EU environment law. The Commission takes the view that the Kingdom of Spain has not classified as Special protection areas territories sufficient in size and in number having regard to the areas of importance for the conservation of birds and natural habitats identified. Certain public projects were not made subject to the environmental impact assessment procedure laid down in Directive 85/337/CEE. The EU Court of Justice have declared that Spain has failed to fulfil its obligations under article 3(b) of the Groundwater Directive and article 4 of Council Directive 91/271/EEC of 21 May 1991 concerning urban waste water treatment. Furthermore, the current work examines the failures concerning Council Directive 1999/31/EC of 26 April 1999 on the landfill of waste and other Council Directives on emissions of certain pollutants into the air.
