¿Contratos prohibidos o regulados? El caso de la prostitución

Resumen

Los modelos paradigmáticos que han servido de base para algunas de las propuestas de modificación de la normativa relacionada con la prostitución son dos: el prohibicionismo sueco y el regulacionismo holandés. El objetivo del artículo es analizar brevemente los efectos obtenidos por estos dos enfoques de cara a una posible regulación de la actividad en España. Las conclusiones indican que ninguno de los dos sistemas ha logrado los resultados pretendidos y que quizá un sistema alternativo que contenga elementos de los dos enfoques pueda arrojar algún resultado positivo, entendiendo como tal, la reducción de la actividad y de las externalidades negativas asociadas.
