Resum

The attribution to a State of terrorist attacks committed by individuals generates an intense juridical discussion. How can a State be held responsible for the acts of individualswhen these do not act under the control or following the instructions of the State? DoesInternational Law declare illegal per se armed interventions carried out in response toterrorist attacks? Is International Law an obstacle when facing such situations? The actions of the self-proclaimed Islamic State (EIIL) are relevant to this issue. In a review ofal-Qaeda’s territorial treatment of global jihadism, the Islamic State focuses on the consolidation of the territory in order to launch a global terrorism campaign against externalobjectives. Considering the capacity of the Islamic State for external projection, such asthe attacks in Paris (November 2015) and Brussels (March 2016) or Istanbul (June 2016),is the international intervention in response to such attacks in the territories of Syria andIraq legal? This study focuses on the analysis of such intervention based on the right ofself-defense, determining whether Article 9 of the Draft Articles on State responsibility forinternationally wrongful acts can be applied to this specific case.
