Abstract

This study is divided into three parts of which we published the first two in thisissue of Aletheia. On the one hand, fundamental rights, both substantive sphere, as a practical, exposing the main difficulties access to court to litigants and how this affects the right to effective judicial protection. Moreover there has been a comparative analysis of the legislation and euro‐ pean case law in this regard, reflecting how the courts have shaped its content through resolu‐ tions. In a second part, we focused on the functioning of the Constitutional Court and spanish appeal for constitutional protection of fundamental rights and public freedoms (application for amparo). This appeal has been the subject of various reforms and controversial doctrinal ways, including incident annulment of the proceedings.
