Resum
After an initial reference of the penalty concept and its purpose, the present paper makes a brief review of absolute theories of criminal penalties and the position of the mainly pioneers of retribution, Immanuel Kant and Georg Wilhelm Friedrich Hegel. Below are exposed the mainly objections for pure retribution and for prevention thesis, seen from the point of view or the retribution theory. Finally it has been look the possible manifestations of the atonement theory and the retribution theory in the Spanish criminal system of law
