The contentious-administrative jurisprudence has maintained, repeatedly, that procedural infractions in the approval of urban pJans determine their nullity asa matter of law, without any possibility that the annulment is accompanied by the retroaction of actions for, where appropriate, the rectification of vice. Faced with the widespread criticism of the doctrine, the judgment that is being commented responds above all to the objective of disavowing them, even íf it is at the cost of blurring the purpose and function that corresponds to the contentious-administrative cassation. The final result is that ajurisprudence that, anchored in an unjustified rigidity in the understanding of legal categories, is reaffirmed, prevents a reasonable response to the problem of procedural defects in the approval of urban instruments.
