Abstract

This paper is concerned with studying whether discretionary border control can be considered an essential competence of state sovereignty and to what extent this right would be justified under liberal theoretical assumptions. We analyze first the liberal arguments that legitimize the sovereignty and powers of States and then review the statist arguments that defend the legitimacy of States to close their borders. At this point, different objections are raised that, without leaving the framework of political liberalism, allow us to conclude stating that the current restrictions on human flows are in open contradiction with the core of basic liberal values that emanate from the political culture of our democratic societies
