Abstract
The guardianship and joint-custody regime does not have a specific regulation in the Civil Code as opposed to what happens in other provincial or regional rights. Neither has the Civil Procedure Act laid down specific rules, thus being the case law of the Tribunal Supremo (Supreme Court) the doctrine which has been setting up certain specialties both substantive as well as procedural on this custody regime. Some of these procedural characteristics are analyzed in this work.
