Abstract

Planned obsolescence is based on a defect in the performance of the products, with the aim of achieving an increase in the replacement thereof and thus increased profits in industries involved in its manufacture. The lack of legal regulation expressly to treat obsolescence has not prevented the use of consumer standards, as well as competition law and even to environmental regulation. From an analytical perspective of private and international nature, will be private disputes with foreign element which focus our study, because the connection of the problem with more than one legal system is often a recurring scenario in a globalized world like today.
