The legal nature of the so-called “ex delicto” is a question that is mostly considered to be settled without questioning its civil character. In the Spanish penal code two concepts of reparation coexist: one civil and one strictly penal. Although the civil concept may materially form part of the criminal concept of reparation, we argue that the criminal concept of reparation is substantially different.
