Abstract
The Spanish Supreme Court has confirmed that the airspace of a State is part of the territory and includes airports and transit areas. The EU rules must be complied with throughout this territory. However, the Supreme Court makes a reprehensible assertion: it excludes the Decision taken under the CFSP framework from mandatory sources of EU secondary law. The Spanish Supreme Court qualifies the CFSP obligations as political (voluntary compliance).
