Laburpena

Bringing the controversy raised by the granting of pardons to some of those convicted of theProcés requires an analysis of the terms in which the granting of this grace is disciplined in thePardon Law of 1870, which is still in force, as well as the doctrine that the Third Chamber of theSupreme Court has been outlining regarding its margins for controlling its exercise by the Government. The confessedly political substance of these pardons will confront the Supreme Courtwith the limits of its own doctrine, thereby revealing the tensions that the maintenance of thisfigure imposes on the very principles of the Rule of Law.
