Zusammenfassung

The European Convention on Human Rights system implies a minimum standard of protection. It provides a margin of appreciation to the States that can better address th specific legal, economic and social realities in wich the ECHR system of guaranteee and protection must be implmented. However, the ECHR will play an important role in monitoring national respect for the rights recognized in the convention. For this reason, it develops autonomous concepts with which it is intented to guarantee and protect the content of the rights and fredoms of nactional classifications and intepretations that can circumvent its meaning and puropose. This paper offers recent examples of case-law wich the doctrine of autonomous concepts is outlined as a technical effective protection of the minimum standrd of human rights against State clims of flight in the application of the procedural an substantive guarantees regime.
