Résumé
Insolvency law is awaiting the transposition of the Directive on preventive restructuring frameworks. The paradigm shift imposed by the European standard in favour of preventive solutions and the evolution from a judicialised to an out-of-court insolvency format requires consideration of the insolvency scenario. It is a good time to recall the objective of our insolvency law. Modern Restructuring Law offers many more options and instruments than currently existing and we should strive to incorporate them.
