Resumo

Across both Europe and The United Kingdom, personal data class actions, and more specifically, those related to massive non-compliance of the law, have turned into a risk corporate area for controllers and processors. In addition, the analysis of cases in the UK evidences the rise of opt-out data class actions. To better understand such context, we have analysed determining factors which have contributed to these trends, in particular, articles 80 and 82 GDPR, and legal framework of the collective redress in the UK. Several cases reached to English Courts will be examined.
