Resum
Ever since financing activity exists, different societies have regulated how to proceed when debtors are not able to pay back their debts. Regulations affect ex post results and also ex ante investment and financing decisions. Companies' survival is determined by applicable legislation during a crisis. Having the appropriate legislation in an increasingly competitive global economy becomes a strategic advantage. Main European Insolvency legislative families are compared among them and with the North American one in order to identify which are the relevant issues of insolvency proceedings. The results offer European legislators a guide to optimize social results of insolvency proceedings.
