Abstract

Our aim in this paper has been to further the understanding of justice, morals, and law as different but related subjects, on the one hand, and analyse the role it should play in a society in crisis, on the other. After considering how defined and evolved the notion of justice in the context of philosophy, we stop, more specifically, raise it in the field of philosophy of law, highlighting successively the names of Kelsen, Hart, Dworkin, and Rawls, and their contributions on the subject.In the following paragraphs we address the case of Spain in the hard times we live in, emphasizing the serious problem of the project of independence raised by Catalonia in the first place, as well as the scourge of corruption that we suffer, secondly. Both cases, of course, are studied starting from a conception in the strict sense of justice and within what we mean by Law State, which works according to its own requirements, that is to say, if the fundamental right of all persons to the effective protection of the judges and courts is recognized and if it complies with the article 117.1 of the Constitution in the sense that justice emanates from the people and is administrated by judges and magistrates who are members of the judiciary, independent, unmovable, responsible and subject only to the rule of law.
