Abstract
The winding-up of companies appears to be one of the most topical issues following the impact of the Covid-19 pandemic. We differentiate between the different winding-up options, whether commercial, bankruptcy or even pre-insolvency, and then study the emergency measures approved and their impact on these institutions. The Restructuring Directive and the draft bill that proposes its transposition raise solutions and doubts about winding-up, especially when we focus on the purchase of business units or whole enterprises.
