Resumen

El presente estudio tiene como objeto el análisis de la determinación del régimen jurídico aplicable a los intereses de demora sobre las cantidades finales que los árbitros conceden en el laudo en el marco de un arbitraje comercial internacional. Se realiza un estudio exhaustivo de las posibilidades que ofrece el método del conflicto de leyes tradicional, pues se utiliza, a pesar de la mayor flexibilidad que tienen los árbitros con respecto a la determinación de la ley aplicable en un arbitraje en comparación con los jueces. Se examinan laudos de arbitraje comercial internacional y de arbitraje de inversiones, así como sentencias judiciales nacionales para proponer soluciones prácticas que ayuden a los árbitros en su determinación con respecto a su competencia para conceder intereses, el periodo de devengo y el tipo de interés aplicable.
