Abstract
This paper is aimed at analyzing a particular legal instrument used to neutralize organized criminality as a phenomenon of collective violence: the clauses which mitigate or exclude the punishment to the criminal who cooperates with Justice. Our opinion will be given in attention to the issue of whether the objective of the aforementioned neutralization is being chased in a respectful manner with the sentencing aims of the social and democratic State
