Resumen

La crisis económica parece minar la legitimidad política del parlamento y del propio sistema democrático. De ahí que debamos volver la vista a un pasado no tan lejano: la Europa de entreguerras y, en particular, la polémica sobre la vinculación entre el modelo parlamentario y la democracia. Con el trasfondo del salto del Estado liberal al social y democrático, Schmitt y Kelsen representan posiciones antagónicas en la relación del parlamento con la democracia y, a pesar de ello, sin razonar sus conquistas y, mejor aún, sus fracasos, difícilmente podremos atisbar una futura regeneración. En especial, la dicotomía democracia identitaria versus procedimental tiene que ser corregida en una ordenación que, desde la forma jurídica, no renuncia a su definición sustantiva
