Abstract
This paper analyzes the nature of the rights and procedural safeguards in the field of arbitration from a national and European perspective, and this as a result of a com-mentary to the Spanish Constitutional Court ruling 17/2021. In particular, it addresses the relationship between the institutional anchoring of the arbitration and the procedural rights and safeguards from the perspective of Articles 24 CE, 47 CFREU and 6 ECHR.*
