Resum
This writing analyses Judgment no. 22/2020 of March 22, 2022 of the Commercial Court no. 1 of Castellón, issued in ordinary insolvency proceedings n.º 412/2020, which resolves whether the right of first refusal in the liquidation plan should be eliminated, as well as its exclusion in the event of the sale of a production unit. The consequences of the suppression or exclusion of the right of first refusal in the insolvency proceedings are also examined.
