Abstract
The passage of Directive (EU) 2019/790 was highly controversial. In seeking to protect the rights of intellectual property owners in the digital single market under a new liability regime applicable to certain service providers, the exercise of users' freedom of expression and information on the Internet seemed to be put at risk. Following the judgment of the CJEU of 26 April 2022 (case C- 401/19), the controversy that has dragged on for years comes to an end, declaring the validity of the EU act and its strict compliance with the Charter of Fundamental Rights of the EU
