Resumen

Se toma como referencia la modificación de la Ley 15/2005 en el Código Civil español, donde se introduce el concepto de guarda y custodia compartida por primera vez en España. El objetivo del presente trabajo es establecer si existe una relación entre los resultados de las investigaciones con base empírica y las decisiones judiciales acerca de los efectos que producen en menores la guarda y custodia compartidas. Para ello se ha realizado un análisis cualitativo de las investigaciones relativas a las consecuencias de la custodia compartida, tanto a nivel nacional como internacional. Posteriormente, se han comparado los resultados de las investigaciones con las decisiones de los magistrados, obtenidas tras realizar un análisis de la jurisprudencia de las sentencias del Tribunal Supremo desde el año 2005 hasta el año 2015.
