Abstract

In the Family Law area, expert technical advice is included in Article 299 of the LEC (Law of Civil Procedure), and it is an increasingly frequent resource in the Spanish legal system due to the existing complexity in the decisions of the courts in the field of guardianship and custody. This article provides a model of a private forensic psychological report performed by two forensic psychology experts of the assessment of the parenting competences of the custodian parent. It also assesses the psychological status of the minor in view of a psychosocial report issued by the Technical Team of the courts, which recommends a change of custody due to the presumed existence of a Parental Alienation Syndrome (PAS), in the presence of the minor’s marked rejection of the mother figure. The results show that this rejection has a constitutional etiology (temperamental characteristics close to the Asperger spectrum), such that parental interference is discarded, and the father’s custody is maintained.
