Derecho penitenciario a la luz de la moderna criminología

Resumen

La presente Tesis tiene como objetivo principal hacer del Saber Criminológico un instrumento útil y de aplicación directa en el Derecho Penitenciario. Para ello, se han tratado de fijar los pilares básicos sobre los que se asienta la Moderna Criminología, continuando con un análisis completo del Derecho Penitenciario actual, como Parte Especial del Derecho Penal, vertiéndose una serie de propuestas de "lege ferenda", tendentes a conseguir una política penitenciaria más eficaz, además del enriquecimiento del Derecho Penitenciario a través del Saber Criminológico. Se ha incidido especialmente, en todas aquellas funciones que el criminólogo podría desarrollar como profesional en el ámbito carcelario, principalmente, basadas en el auxilio y asesoramiento ante los requerimientos de Autoridades Judiciales, Fiscales, y Centro Directivo, con especial atención al Juez de Vigilancia Penitenciaria. Se propone la mediación penitenciaria, como una herramienta que disminuya el nivel conflictual intrapenitenciario y devuelva la responsabilidad del proceso a las partes. The present Thesis must like primary target make of Criminological Knowledge a useful instrument and of direct application in the Penitentiary Right. For it, they have been to fix the basic pillars on which the Modern Criminology is based, continuing with a complete analysis of the present Penitentiary Right, like Special Part of the Penal Right, spilling a series of proposals of "lege ferenda", tending to obtain a more effective penitentiary policy, in addition to the enrichment of the Penitentiary Right through Criminological Knowledge. It has been affected specially, in all those functions that the criminologist could develop like professional in the prison scope, mainly, based on the aid and advising before requirements of the Judicial, Fiscal Authorities, and Directive Center, with special attention to the Judge of Penitentiary Monitoring. The penitentiary mediation sets out, like a tool that diminishes the intrapenitentiary conflictual level and gives back the responsibility of the process to the parts.
