Zusammenfassung
A significant feature of international commercial contracts at present is the trend to favour the application of non-national or transnational rules and standards, such as the UNIDROIT Principles on international commercial contracts. This article examines in detail the effectiveness of such rules in resolving disputes both before national courts and before arbitration tribunals. As regards national courts, the article contains new directions for the interpretation of the conflict of laws provisions focusing on the effects to be given to transnational rules in the framework of the 1980 Rome Convention on the law applicable to contractual obligations.
