Abstract

This paper attempts to compare the legal treatment of hate speech in the United States and in the Council of Europe. In the former, this type of speech is part of freedom of expression, which enjoys very wide margins in this country; in the latter, on the other hand, such speech can be legitimately restricted, which responds to the model of militant democracy that prevails in the Council of Europe. Once both models have been analyzed, an analysis is made of the extent to which they could serve as a reference for the Spanish legal system.
