Abstract

The aim of this research is a comprehensive analysis of the African Court on Humanand Peoples' Rights (ACtHPR). To this end, we have posed five central research questions, each of which forms the backbone of a chapter of the doctoral dissertation. Thus, the first of these aims to answer the question of how the regional system in which the ACtHPR is inserted functions. This leads us to an analysis of both its normative instruments and the non-jurisdictional guarantee and control mechanisms created within it. This introductory framework serves as a basis for subsequently answering the question of how the ACtHPR works, by examining the process of creating the ACtHPR, as well as its composition, organisation and jurisdiction; in the latter respect, both in its contentious and consultative aspects. Moreover, each of these issues is analysed with regard to the proposed jurisdictional bodies of the system. In the light of the above, and as a third research question, we turn our attention to how and under what requirements the procedure before the ACtHPR takes place; again, and following a uniform pattern, both on the contentious and on the advisory level...
