Abstract

Before long I had started my investigation in this area whose results I will try to show in this document, this topic is interesting for criminal professionals and our society in general. This essay represents a complex reality as it contains a mix of expertise that has not been worked on previously by different case studies in Criminal Law.I did not want to do partial research as other assignments but rather I wanted to show this complete reality, keeping in mind that it had to maintain a thesis form, in order to indicate the main problems these mental patients suffer when they commit a crime and they are not found guilty because their capacities were not adequate to receive a penalty or a security measure.Finally, this investigation tries to show the main disadvantages related to non-compliance with laws, rights violations, lack of effectiveness in the healthcare and social system, justice administration, penal institution and all legal articles in need of urgent improvements...
