Zusammenfassung
This article analyses the class formation regime under the Spanish Insolvency Act, its relevance in connection with restructuring plans and the mandatory and voluntary criteria set forth in the Act. This article also analyses other comparative law frameworks different to the Spanish framework which can be helpful for interpretation purposes, as well as recent judicial decisions issued in connection with class formation.
