Abstract

The text addresses the question of the correction of Trade Union candidacies in the elections to Work Councils in the space between the provisional and final proclamation when some of these, lose part of their members, but save 60% of the same. The doctrine said that this guarantee must be granted ex officio by the electoral board as the best way to safeguard the right to freedom of association seemed to be consolidated. However, the recent ruling of the Constitutional Court of November 14, 2022 shows how an organ of the social jurisdiction applies a restrictive view by understanding that it is a mere faculty that must be remedied by the party. Our Court of Guarantees has had to rectify this interpretation by reiterating its classic doctrine, which has been established throughout its history and is analyzed in the text.
