Resum
A judgment of the Supreme Court of 22nd September 2021 (RC 293/2020) regarding the compulsory purchase of real estate subject to a special leasing regime is analyzed in this paper. The Supreme Court annuls section 6.2.b) of the Valuation Regulation that provided for the possibility of deducting from the fair value that must be paid to the expropriated the compensation that must be granted to the tenant affected by the compulsory purchase and whose contract is subject to legislation specific in the matter that makes it impossible for the landlord to achieve normal market profitability
